In a landmark ruling that reaffirms the authority of traditional leadership and the constitutional role of the presidency, the Supreme Court of Appeal (SCA) has overturned a previous High Court judgment that sought to invalidate President Cyril Ramaphosa’s recognition of King Misuzulu kaZwelithini as the rightful monarch of the AmaZulu nation.
The decision has been warmly welcomed by the AmaZulu royal family, who view it as a vindication of both the King’s legitimacy and the President’s constitutional powers.
The dispute stems from a challenge to President Ramaphosa’s 2022 decision to officially recognize King Misuzulu as the successor to the late King Goodwill Zwelithini. The High Court had previously ruled that the President’s recognition was procedurally flawed, casting uncertainty over the King’s status.
However, the SCA found that Ramaphosa had acted within the bounds of the law and the Traditional and Khoi-San Leadership Act, which empowers the President to recognize traditional leaders following consultations and due process.
